This Privacy Policy explains how VividScale (“we,” “us,” or “our”) collects, uses, discloses and protects your personal data when you visit our website at vividscale.com (the “Website”), use our services, or interact with us in any way.
VividScale is a YouTube content agency registered in India. We serve clients globally and are committed to protecting personal data in compliance with India’s Digital Personal Data Protection Act, 2023 (“DPDP Act”), the EU General Data Protection Regulation (“GDPR”), the California Consumer Privacy Act as amended by the CPRA (“CCPA/CPRA”), and other applicable privacy laws.

- Service data: YouTube channel credentials, brand assets, content briefs, recordings you provide under a service agreement
Information collected automatically:
- Technical data: IP address, browser type and version, operating system, device identifiers, time zone
- Usage data: pages visited, time spent on pages, referring URLs, click patterns
- Cookie data: information collected through cookies and similar tracking technologies (see our Cookie Policy for details)
Information from third-party sources:
- Analytics data: Google Analytics collects aggregated usage data about website traffic and behavior
- Scheduling data: Calendly collects name, email, and scheduling preferences when you book a call
3. How We Use Your Personal Data
We use your personal data for the following purposes: responding to inquiries and contact form submissions, providing YouTube channel management services, sending service-related communications, sending marketing communications (only with your consent), website analytics and improvement, invoicing and payment processing, and complying with legal obligations under tax law, FEMA, and GST.
Under GDPR, our legal bases include legitimate interest, performance of contract, consent, and legal obligation. Under the DPDP Act, our bases include consent, contractual necessity, legitimate use, and legal obligation.
We will never use your personal data for a purpose incompatible with the purposes listed above without notifying you and, where required, obtaining your consent.
4. How We Share Your Personal Data
We do not sell your personal data. We may share your data with service providers such as Google Analytics, Calendly, Wise (for payment processing), and Zoho Invoice (for billing), all of which process data on our behalf under contractual obligations. When managing your YouTube channel under a service agreement, we access and interact with YouTube’s platform using credentials you provide. We may also share data with our accountants, legal advisors, or auditors where necessary for compliance, and where required by law, regulation, legal process, or governmental request.
Your data may be transferred to and processed in countries outside your country of residence, including India, the United States, and the European Union. Where we transfer data internationally, we ensure appropriate safeguards are in place as required by applicable law.
5. Data Retention
We retain your personal data only for as long as necessary to fulfil the purposes for which it was collected. Website visitor analytics data is retained for 14 months (Google Analytics default). Contact form and inquiry data is retained for 2 years from last interaction, unless you become a client. Client service data is retained for the duration of the service agreement plus 7 years to comply with Indian tax and accounting requirements under the Income Tax Act, 1961 and GST law. Invoicing and payment records are retained for 7 years as required by Indian law. After the retention period, data is securely deleted or anonymized.

7. Your Rights
All individuals: You have the right to know what personal data we hold about you, to request correction of inaccurate data, to request deletion of your data (subject to legal retention requirements), and to withdraw consent at any time.

If you are in the EU/EEA (GDPR): You have the right to access (Article 15), rectification (Article 16), erasure (Article 17), restriction of processing (Article 18), data portability (Article 20), to object to processing based on legitimate interest (Article 21), to not be subject to automated decision-making (Article 22), and to lodge a complaint with your local Data Protection Authority.
If you are in California (CCPA/CPRA): You have the right to know what personal information is collected, used, shared, or sold, to delete personal information, to opt out of the sale or sharing of personal information, to correct inaccurate personal information, to limit use of sensitive personal information, and to non-discrimination for exercising your rights.

8. Data Security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These include encrypted data transmission (SSL/TLS), access controls, regular security reviews, and contractual security obligations on our service providers. No method of transmission over the internet is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
9. Children’s Privacy
Our Website and services are not directed at individuals under the age of 18. We do not knowingly collect personal data from children. If we become aware that we have collected data from a child, we will take steps to delete it promptly.
